Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") form a binding agreement between you and NLH Enterprises LLC, a Utah limited liability company doing business as "Viagem" ("Viagem," "we," "us," or "our"), based in Utah, USA. By creating an account or otherwise using the website, web app, or any related services (the "Service"), you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under the laws of your jurisdiction. The Service is intended for parents and other adult guardians planning family travel. Children under 13 may not create accounts. Parents may include children in their family profile, as described in the Privacy Policy.

3. Your account

• You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
• You agree to provide accurate information about your family travelers and to keep it reasonably current. We use this information to grade trips, not to verify identity.
• One account per household. Sharing access with people outside your household is not permitted.
• You may delete your account at any time from your profile. We will delete or anonymize your data on the schedule described in the Privacy Policy.

4. Pricing and billing

Free during early access. Viagem is currently free to use. The Service is funded by affiliate commissions we earn when you book through our brand-direct handoffs (see Section 8), not by subscription fees. You are not charged anything to plan trips or use the trip grades today.

If we introduce paid features later. We may offer paid subscriptions or premium features in the future. If we do, the terms below will apply, and we will show current pricing and obtain your agreement at checkout before any charge:

• Pricing. Any pricing will be shown on the pricing page and at checkout before any charge. No charge will occur without your express agreement.
• Auto-renewal. If a paid subscription auto-renews, that will be disclosed at signup, and the subscription will renew at the then-current rate at the end of each billing period until you cancel. You authorize us (through our payment processor) to charge your payment method for each renewal.
• Cancellation. You can cancel anytime from your profile. Cancellation takes effect at the end of the current billing period; you keep paid access until then. We do not provide pro-rated refunds for partial periods, except where required by applicable law.
• Price changes. If we change subscription prices, we will give you at least 30 days' notice before the change takes effect on your subscription. You can cancel before the new price takes effect.
• Promotional pricing. Promotional offers (such as launch pricing) apply only to subscriptions started during the offer window and may renew at the standard rate. Terms specific to each offer will be disclosed at signup.
• Failed payments. If a payment fails, we may suspend paid access until the issue is resolved, and may retry the payment per the payment processor's standard retry schedule.
• Taxes. Any prices are exclusive of applicable taxes. You are responsible for any taxes owed.

5. Bookings and third-party suppliers

Viagem grades flight, hotel, and trip options and hands you off to the airline, hotel, or other supplier's own website to complete the booking. Viagem is not a travel agency, online travel agency (OTA), tour operator, or merchant of record for any trip you book. Your booking contract is between you and the airline, hotel, or other supplier — not with Viagem. Their terms, cancellation policies, change fees, and customer service apply to the booking itself.

We use commercially reasonable efforts to keep flight prices, hotel rates, availability, and amenity information current, but the supplier's own site is always the source of truth at the moment of booking. We are not liable for differences between what Viagem displays and what the supplier ultimately charges or delivers.

6. Loyalty programs and perks

Viagem defaults every booking to brand-direct routing so that the perks the family pays for (family rooms, connecting seats, full loyalty points, elite-night credit, member rates) credit to you. We will never route you through an OTA in order to earn ourselves a higher commission when a viable direct option exists. When no direct option is available, we will disclose it clearly and note that loyalty perks may not credit through that channel.

We do not control loyalty programs and do not guarantee any specific loyalty outcome. Whether points, elite-night credit, status benefits, or other perks post is between you and the program. Programs change their terms, fares change their earning rules, and brands occasionally make mistakes. Viagem is not responsible for missed earnings, downgraded status, or other loyalty-program outcomes.

7. AI-generated itineraries

Some features of the Service generate trip itineraries using artificial intelligence. We work hard to ground these in real, current information, but AI can make mistakes about hours of operation, prices, age limits, weather, availability, and other facts. Always verify before relying on a specific recommendation — especially anything safety-related (age-gated activities, allergies, water depth, transport bookings, age restrictions on alcohol or rentals). Viagem disclaims any warranty as to the accuracy, completeness, or reliability of AI-generated content.

8. Affiliate relationships and disclosure

Viagem participates in affiliate programs operated by Commission Junction (CJ), Awin, Impact, and others. We may earn a commission when you click a booking link from Viagem and complete a qualifying booking. This commission does not increase the price you pay, does not change which option Viagem grades highest for your family, and does not cost you any loyalty perks — by design, we route to brand-direct partners that preserve full loyalty earnings. Affiliate commission is what funds the Service, which is free to use during early access.

We comply with the U.S. Federal Trade Commission's endorsement guides. Where required, individual booking links include the standard affiliate-link disclosure.

9. License to use the Service

Subject to your compliance with these Terms, Viagem grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for the planning of your family's travel. This license does not include any right to (a) resell or commercially use the Service, (b) collect or use any data from the Service for the benefit of any other party, (c) make derivative works of the Service or its content, (d) reverse-engineer or attempt to extract the source code, or (e) use any data mining, robots, scraping, or similar collection methods.

10. Acceptable use

You agree not to:

• Use the Service to facilitate fraud, harm to others, or any unlawful activity.
• Reverse-engineer, decompile, scrape, or abuse rate limits.
• Resell, sublicense, or share account access outside your household.
• Upload or transmit malicious code or content that infringes another party's rights.
• Interfere with or disrupt the Service or its servers.
• Use the Service to develop, train, or improve any competing artificial-intelligence model or travel-planning product.

We may suspend or terminate your account for any violation of this section, with or without notice.

11. Intellectual property

Viagem and its licensors retain all right, title, and interest in and to the Service, including all software, design, text, graphics, logos, and the "Viagem" name and mark. Nothing in these Terms transfers any of that intellectual property to you. AI-generated itinerary content that we provide to you is provided under the license in Section 9 and may not be republished or commercialized.

12. Feedback

If you send us suggestions, feedback, or ideas about the Service, you grant Viagem a worldwide, perpetual, royalty-free, irrevocable license to use, reproduce, modify, and otherwise exploit that feedback for any purpose, without any obligation to you.

13. Third-party services and links

The Service includes links and integrations with third parties (airlines, hotels, affiliate networks, AI providers, and others). We are not responsible for the availability, content, accuracy, or practices of any third-party service. Your dealings with third parties are between you and them.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIAGEM DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT TRIP GRADES, AI-GENERATED ITINERARIES, PRICES, OR AVAILABILITY WILL BE ACCURATE OR CURRENT.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL VIAGEM OR ITS AFFILIATES, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

VIAGEM'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID VIAGEM IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

16. Indemnification

You agree to defend, indemnify, and hold harmless Viagem and its affiliates from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any content you submit. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, at your expense.

17. Dispute resolution and binding arbitration

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that you may bring a claim in small-claims court if it qualifies. The arbitration will take place in Salt Lake County, Utah, or remotely at your option. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.

Class-action waiver.You and Viagem each agree that any Dispute will be resolved only on an individual basis. Neither party may bring or participate in a class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

30-day opt-out. You may opt out of this arbitration agreement and class-action waiver by emailing us at support@viagem.comwith the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out will not affect any other provision of these Terms.

Exceptions. This arbitration agreement does not apply to any claim that is properly the subject of small-claims court, or to any action by Viagem to enforce its intellectual-property rights or seek injunctive relief.

18. Governing law and venue

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws principles. Subject to Section 17, any Dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of those courts.

19. Termination

You may terminate these Terms at any time by deleting your account. We may suspend or terminate your access at any time for violation of these Terms or for any other reason, with or without notice. Sections of these Terms that by their nature should survive termination (including Sections 11, 14, 15, 16, 17, 18, and 22) will survive.

20. Changes to these Terms

We may modify these Terms from time to time. We will update the "Effective" date at the top of the page. If a change is material, we will provide at least 30 days' notice in-app or by email before it takes effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not accept the change, your remedy is to stop using the Service (and cancel any paid subscription) before the effective date.

21. Force majeure

Viagem is not liable for any failure or delay in performance due to events beyond our reasonable control, including natural disasters, war, civil disturbance, governmental action, labor disputes, internet outages, or service-provider failures.

22. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and Viagem and supersede any prior agreement on the same subject.
• Severability. If any provision is held unenforceable, the remaining provisions remain in full effect.
• No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
• No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
• Headings. Section headings are for reference only and do not affect interpretation.
